Step 6: Memorandum of Understanding

  • The OHCSF and the Developer will enter into a Memorandum of Understanding (MoU) in line with agreed terms and conditions during the negotiation meeting.
  • The MoU conveys a convergence of will between the two parties, indicating intended common line of action and obligations of both parties in providing quality and affordable housing to Civil Servants.
  • It states clearly the level of responsibility by the Developer and the OHCSF (FISH Department) in the partnership, before, during and after the property is handed over to the Off-taker.
  • The MoU will also state the levels of payment to the Developer before the property is handed over to the Off-taker and the payment channels either through a PMI or direct to the Developer Bank Account, and agreed payment pattern for the outstanding amount , if any.
  • It also specifies the agreed number of Houses to be delivered to the FISH Programme, the House Types, House Prices and timeline for the delivery of the Houses.
  • The document will be prepared by the Legal Unit of the OHCSF and signed by representatives of both parties.
  • Upon signing the MoU, Houses offered by the Developer(s) will be uploaded on the FISH Platform and the list of Off-takers forwarded to the Developer(s) for issuance of House Offer/Allocation Letters.

ISSUANCE OF HOUSE OFFER/ALLOCATION LETTER

  • The House Offer Letter is to be prepared in line with the FISH Standard House Offer Template.
  • The Template is designed to provide clarity and guidance on what is required from both parties (Off-takers and Developers) and reflects detailed information on Offer specifications, Terms and Conditions for the possession of the House and mode of payment so as to avoid any form of ambiguity.
  • The Offer Letter constitutes the initial collateral and juristic vehicle under OHCSF with rights to deductions from Civil Servants’ remunerations under Integrated Personnel Payroll Information System (IPPIS) for their acquired house under the FISH Programme.
  • On receipt of the bulk offer/allocation letters, the FISH Department will notify the Off-takers and invite them to confirm acceptance of the offer. Thereafter, copies of the documents will be forwarded to the relevant financial Institution for processing of mortgage payments to the Developer
